PLEASE READ THESE TERMS CAREFULLY. YOUR ACCESS TO OR USE OF THE MONTEGO PLATFORM CONSTITUTES YOUR ACKNOWLEDGEMENT AND AGREEMENT THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE LEGALLY BOUND BY ALL OF THE FOLLOWING TERMS.

INTELLIZE LLC operates the MonteGO platform solely as a digital technology platform and does not provide transportation services directly. All transportation and transfer services offered through the platform are provided by independent third-party service providers.

SECTION A: GENERAL TERMS APPLICABLE TO ALL USERS

1. The Agreement and Parties

  • 1.1. These General Terms of Use ("Terms") constitute a legal agreement between INTELLIZE LLC ("Company," "MonteGO," "we," "us") and you, as a user of the MonteGO platform ("Platform User," "you"). 
  • 1.2. These Terms apply to all Platform Users, including individuals and entities requesting services ("MonteGO Users") and the independent third-party providers who offer services through the platform ("MonteGO Service Providers"). 
  • 1.3. Section A contains general provisions applicable to all Platform Users. Section B specifies additional terms applicable only to MonteGO Users. Section C specifies additional terms applicable only to MonteGO Service Providers. 
  • 1.4. By downloading, accessing, or using any part of the MonteGO platform (including the MonteGO Application and the MonteGO Driver Application), you irrevocably agree to these Terms and our Privacy Policy.

2. The Service and MonteGO's Limited Role

  • 2.1. A Technology Platform: MonteGO is not a transportation company, taxi operator or employer. MonteGO provides a technology platform that connects MonteGO Users with independent MonteGO Service Providers. 
  • 2.2. Disclaimer of Responsibility: MonteGO's role is limited to providing this technological connection. The transportation and transfer services themselves are provided by independent MonteGO Service Providers. MonteGO is not responsible for the actions, omissions, quality, safety, or legality of the services provided by Service Providers.

3. General Obligations and Code of Conduct

  • 3.1. Lawful and Respectful Use: All Platform Users agree to use the platform for lawful purposes only and to treat other users with respect. Harassment, discrimination, verbal or physical abuse, and any illegal activity are strictly prohibited. 
  • 3.2. Account Security: You are responsible for all activity that occurs under your account and for maintaining the confidentiality of your account credentials. 
  • 3.3. No Platform Manipulation: You may not attempt to manipulate ratings, bypass the commission structure, or reverse-engineer any part of the platform.

4. Termination

  • MonteGO reserves the right, at its sole discretion, to suspend or terminate any user's account and access to the Platform without notice for any breach of these Terms or related policies.

5. Limitation of Liability and Dispute Resolution

  • 5.1. THE PLATFORM IS PROVIDED "AS IS." MONTEGO DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED OR ERROR-FREE. 
  • 5.2. MONTEGO SHALL NOT BE LIABLE FOR ANY DAMAGES ARISING FROM INTERACTIONS BETWEEN PLATFORM USERS. 
  • 5.3. These Terms shall be governed by the laws of Montenegro. The Courts in Podgorica, Montenegro, shall have exclusive jurisdiction over any dispute arising from these Terms.

SECTION B: ADDITIONAL TERMS FOR MONTEGO USERS

6. Service Requests and Payment

  • 6.1. When you request a taxi or transfer service through the MonteGO Application, you agree to receive that service.
  • 6.2. You are obligated to pay the full fee for the services you receive directly to the MonteGO Service Provider upon completion. 
  • 6.3. Respect for Property: You are financially responsible for any damage you cause to a MonteGO Service Provider's vehicle or property.

SECTION C: ADDITIONAL TERMS FOR MONTEGO SERVICE PROVIDERS

7. Service Provision and Legal Compliance

  • 7.1. Warranty of Legal Compliance: By offering services on the platform, you warrant that you possess all necessary licenses, permits, authorizations, and insurance to legally provide your services (e.g., passenger transport). 
  • 7.2. Accurate Information: You commit that all information you provide to the platform (including personal details, vehicle information, licenses, and service terms) is accurate, complete, and current. 
  • 7.3. Sole Responsibility: You are solely responsible for the quality and safety of your services, the maintenance of your vehicles, and the legal compliance of your operations.

8. Contractual Relationship

  • 8.1. These Terms, together with the "MonteGO Digital Platform Service Provider Agreement" you separately agree to, form a complete agreement. In case of a conflict between the two documents, the provisions of the Service Provider Agreement shall prevail for you. 
  • 8.2. You are responsible for collecting payment directly from the MonteGO User. MonteGO is not responsible for non-payment by the User.
